1. Acceptance of Terms

Your use of the Panama Marketplace website signifies your automatic acceptance of these terms and conditions, including any future amendments.

2. Right to Modify

Panama Marketplace reserves the right to modify, discontinue, or delete website services and user data, temporarily or permanently, with or without prior notice. We are not liable for issues with data timeliness, interruption, cancellation, storage failure, inaccuracy, or incorrect delivery. By accepting these terms, you authorize us to modify or delete inaccurate, misleading, or policy-violating information you provide and to disconnect service if necessary.

3. User Responsibilities and Registration

To use Panama Marketplace, you must register, provide truthful information, and be at least thirteen (13) years old. Registration implies agreement to these terms, which may be modified by the Panama Marketplace team at any time.

4. Privacy Policy

Your registration data and personal information are subject to our Privacy Policy. You affirm that all information provided is true, correct, complete, and lawful. In case of a judicial or police investigation, you release Panama Marketplace from liability and agree that we may share your data with authorities. We may seek recourse for damages caused by you. You may be asked to update your data, and refusal may lead to account deactivation.

5. Consent to Use Information

Registering and posting ads makes your information publicly available on our network, facilitating contact with potential consumers. You own the information you provide, but by registering, you grant us irrevocable rights to use images for reference, marketing, or historical data on our platform and other digital and mass media. Providing information through contact forms or social media creates a Panama Marketplace account, streamlining communication and transactions.

6. Account Deletion

Registered users can request account deletion through our contact channels, which may take up to 5 business days. Emergency deletion can be requested by phone. Upon deletion, we remove your information and listings from our network, but we are not responsible for listings remaining on search engines or other unrelated sites.

7. Registration and Password

You are responsible for safeguarding your login information (user ID, email, password) and notifying us immediately of any unauthorized use. You release Panama Marketplace from liability for your negligence in the misuse of your personal information.

8. Conduct

You are solely responsible for all content (text, software, code, music, sound, photos, graphics, video, or other materials) you provide to Panama Marketplace. You agree not to violate copyright or trademark laws. We may remove offensive, illegal, or fraudulent content, but this does not make us responsible for user-posted content. When using our website or services, you explicitly agree not to:

1. Provide unlawful, threatening, harmful, abusive, harassing, stalking, tortious, defamatory, vulgar, obscene, offensive, objectionable, pornographic, or virus-infected content or engage in conduct that disrupts the website or service, or violates any local, national, or international law.
2. Impersonate or misrepresent your association with any person or entity, or conceal/falsify content origin.
3. Collect, take, lend, or distribute data about other users (photos, emails, descriptions).
4. Use the website or service to send spam, phishing, pyramid schemes, or unauthorized advertising.
5. Provide content that may lead to our civil or criminal liability or violate any local, national, or international law, including copyright, trademark, patent, or trade secrets.
6. Periodically refresh, rewrite, or re-publish your ad to appear on the front page or remain first in listings.
7. Open multiple free accounts with the same email, name, organization, company, logo, and/or contact information.
8. Include photos in animated GIF format in highlighted ads.
9. Post classified ads in the wrong categories.
10. Publish ads for paid categories (Real Estate, Cars, Electronics) in free categories.
11. List more than one product per listing, including replacing items under the same ID or including a price list for multiple products.
12. Post photos with other ads inserted, superimposed phones, social networks, or advertiser advertising.
13. Include advertising, phone numbers, emails, social networks in the description and title, or use the space to advertise something other than the good.
14. Include unrealistic prices.
15. Advertise properties in incorrect locations.

For real estate and vehicle listings, you must include a minimum of three (3) photos per listing, center the product occupying 95% of the image, and avoid adding margins, design elements, logos, QR codes, unrelated text, or contact information.

Inappropriate conduct towards Panama Marketplace agents, staff, executives, and owners, including insults, yelling, racism, vulgarity, or threats, will result in an immediate and permanent ban from your account and all related content. We strive to maintain respect, courtesy, and patience with all users and customers.

9. Submission of Content

Violation of the following prohibitions may lead to ad deactivation without refund, account cancellation, and provision of user information to authorities:

• Prohibited are ads outside their category.
• Prohibited are advertisements promoting other websites without our prior written authorization.
• Prohibited are duplicate or repeated advertisements.
• Prohibited are postings or comments containing inappropriate or obscene language.
• Prohibited are advertisements with political or religious content, or content scandalously contrary to morality and good customs.
• Prohibited are advertisements that threaten the interests of this website, whether they promote or incite our users to use products and services that directly compete with Panama Marketplace.
• Ads that degrade the quality of the content displayed on the platform, or ads with insufficient information about the listing, including descriptions and photos, will not be allowed.

When providing any content to Panama Marketplace, you agree:

1. To grant us a worldwide, royalty-free, perpetual, non-exclusive license (including moral rights) to use, display, reproduce, modify, adapt, publish, distribute, perform, promote, archive, translate, and create derivative works and compilations, in whole or in part, in any form, media, or technology now known or later developed.
2. You warrant that you have all necessary legal, moral, and other rights to grant us this license.
3. You acknowledge that we have the right (but not the obligation) to refuse to post, remove, or block access to any content you provide at any time and for any reason, with or without notice.

10. Indemnification

You agree to indemnify and hold us, our subsidiaries, affiliates, related parties, officers, directors, employees, agents, independent contractors, advertisers, partners, and co-owners harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising from your conduct or connection with this Website or Service, your content provision, your violation of these Terms of Use, or any other violation of another's rights.

11. Disclaimer of Warranties

Your use of Panama Marketplace and any provided services or content (the "Service") is at your sole risk. The Service is provided "as is," and we expressly disclaim all implied or express warranties of goodwill, including, but not limited to, warranties of product quality, fitness for a particular purpose, and non-infringement.

We make no warranties, implied or express, that any part of the Service will be uninterrupted, error-free, virus-free, timely, secure, accurate, reliable, or of any quality, or that any Content is safe for downloading. Neither we nor any participant in the Service provides professional advice, and your use of such advice or information is entirely at your own risk and without liability on our part.

Some jurisdictions may not allow the disclaimer of implied warranties, so this disclaimer may not apply to you regarding implied warranties.

12. Limitation of Liability

You expressly understand and agree that Panama Marketplace shall not be liable for any direct, indirect, special, incidental, or consequential damages, including but not limited to, damages for loss of profits, goodwill, use, data, or other intangible losses (even if we have been advised of the possibility of such damages), resulting from or arising out of:

1. the use of or inability to use the Panama Marketplace service,
2. the cost to obtain substitute goods and/or services resulting from any transaction through the use of the Panama Marketplace service,
3. unauthorized access to or alteration of your data transmissions,
4. statements or conduct of any third party on the Panama Marketplace Service, or
5. any other matter relating to the Panama Marketplace Service.

In some jurisdictions, limitations of liability are not permitted, and therefore such limitations may not apply to you.
